1. General

1.1. These Terms of Use (“Terms”) govern access to and use of the official website of Marathon Varna (the “Website”), including its language versions (Bulgarian and English), subdomains, and related online services.

1.2. The Website is operated by STUDENT TOURIST SOCIETY ACADEMIC (the “Organiser”, “we”, “us”).

1.3. By using the Website (browsing, registering, logging into a participant account, sending messages, making payments, etc.) you confirm that you have read, understood, and accept these Terms. If you do not agree, please do not use the Website.

1.4. These Terms apply together with:

• the

  Privacy Policy

  — on personal data processing;

• the

  Participation Terms

  for the relevant Marathon Varna edition — published on the Website (e.g. the

  Participation terms

  page) and accepted separately during online registration.

If there is a conflict between these Terms of Use and the Participation Terms regarding the race itself, the Participation Terms prevail.

2. Organiser details

3. Scope of services

3.1. The Website provides informational and organisational services related to Marathon Varna, including without limitation:

• information about the event, distances, programme, course, prize fund, and partners;

• news and articles;

• online registration

  for the active race edition;

• a

  participant account

  — status overview, fee payment, confirmation download;

• a

  public list of registered participants who have paid

  (limited data — see the Privacy Policy);

• photo galleries

  (uploaded by the Organiser and/or via integration with a third-party photo platform);

• results

  and links to external live-results systems (when available);

• a

  contact form

  for enquiries to the Organiser.

3.2. The Website does not provide medical advice, training plans, or a guarantee of fitness. The decision to take part in the race is your personal responsibility and is governed by the Participation Terms.

3.3. The Organiser may change, suspend, or limit Website features (e.g. opening/closing registration or online payment) according to the edition schedule, without prior notice unless the law requires otherwise.

3.4 Gallery and photo search. The Site may offer event photos via MyRacePix integration — by bib number and/or by selfie. Selfie search is voluntary, requires consent under the Privacy Policy, and is available only when enabled for the relevant edition. You are responsible for the image you upload (e.g. do not upload photos of third parties without permission). Results are indicative; the organizer does not guarantee that every photo is included.

4. Access, age, and registration

4.1. The Website is open to the general public. Online registration requires a minimum age of 16 at the time of registration (based on the “year of birth” field). Higher age requirements may apply to specific distances (e.g. the full 42 km marathon) under the Participation Terms.

4.2. You must provide accurate, complete, and up-to-date information. False information may lead to refusal, cancellation, or correction of your registration.

4.3. Registration for an edition uses a unique email address per participant. Multiple active registrations for the same edition with the same email are not allowed.

4.4. Creating a participant account requires a password. You are responsible for keeping it confidential and for all activity under your account. Notify us immediately if you suspect unauthorised access.

4.5. When registering, you confirm that you have read and agree to the applicable Participation Terms for that edition. The time of acceptance is recorded in the system.

5. Fees, payments, and registration status

5.1. Entry fees, early/standard registration periods, and payment rules are set out in the Participation Terms and the fee table on the Website for the relevant edition.

5.2. Online payment (when enabled) is processed via a secure connection to a licensed payment service provider — KBC Bank (UPC/ePay) and/or Borica AD, depending on site configuration. The Organiser does not store full card details; processing is performed by the bank/payment operator.

5.3. If the fee is not paid within the deadline set by the Organiser (by default 20 calendar days from registration unless another deadline is announced for the edition), the registration may be cancelled (“payment expired”). A new registration is then required unless the Organiser states otherwise.

5.4. You appear in the public participant list only after successful payment and assignment of a bib number (where applicable).

5.5. The Organiser may send email reminders before the payment deadline expires. Opting out of registration-related emails does not waive the obligation to pay on time.

6. Promo codes and discounts

6.1. Promo codes (if available) are entered during registration or as directed by the Organiser. Invalid, expired, or exhausted codes do not entitle you to a discount.

6.2. The Organiser may withdraw, change, or refuse a promo code in case of abuse, technical error, or breach of campaign rules.

7. User conduct

When using the Website you must not:

• break applicable law or third-party rights;

• attempt unauthorised access, security testing, DDoS, or scraping beyond normal use;

• submit false data, impersonate others, or create duplicate registrations in breach of section 4.3;

• bypass technical limits (rate limiting, honeypot fields, signed URLs);

• upload or transmit malware, spam, or unlawful, defamatory, discriminatory, or offensive content via the contact form;

• use Website content outside the limits in section 8.

Breaches may result in access blocking, registration cancellation, and/or notification of authorities.

8. Intellectual property

8.1. Website content (text, graphics, logos, photos, videos, software, databases, design) is protected by copyright and/or other IP rights of the Organiser or licensors (sponsors, partners, photographers).

8.2. Temporary reproduction of pages for personal, non-commercial information is permitted. Any copying, distribution, public display, or commercial use requires prior written consent from the Organiser unless the law allows otherwise.

8.3. Sponsor and partner trademarks belong to their respective owners.

9. External links and third-party services

9.1. The Website may link to third-party sites (e.g. Decathlon, YouTube, results systems, MyRacePix for photos). The Organiser does not control those sites and is not responsible for their content or policies.

9.2. YouTube embeds use youtube-nocookie.com where technically possible to limit cookies until the player loads.

9.3. Use of external services is subject to the respective provider’s terms.

10. Liability and disclaimers

10.1. The Website is provided “as is” and “as available” within the Organiser’s reasonable technical and organisational means.

10.2. The Organiser strives to keep the Website available and accurate but does not guarantee uninterrupted operation, error-free content, or compatibility with all devices and browsers.

10.3. To the fullest extent permitted by law, the Organiser is not liable for:

• indirect, incidental, or consequential loss arising from use or inability to use the Website;

• acts of payment operators, hosting providers, email services, or other third parties;

• content submitted by users via the contact form, except in case of wilful misconduct by the Organiser.

10.4. Liability for health, injury, and participation in the race is governed solely by the Participation Terms and applicable law, not by these Website Terms of Use.

10.5. Mandatory consumer protection rights under Bulgarian law (where applicable) remain unaffected.

11. Changes

11.1. The Organiser may update these Terms. The new version takes effect on the date published on the Website unless a later date is stated.

11.2. Material changes may be highlighted on the Website. Continued use after the effective date constitutes acceptance unless the law requires explicit consent.

12. Governing law and disputes

12.1. Bulgarian law applies to matters not covered here.

12.2. Disputes should be resolved amicably; failing that, the competent Bulgarian court at the Organiser’s seat has jurisdiction unless mandatory EU/Bulgarian rules provide otherwise (e.g. for consumers).
